Gross adds that Avery's misdemeanor charge comes with potential penalty of up to one year in jail and/or $2,000 fine.

TMZ has more...
"According to law enforcement sources, a neighbor called police to complain about the noise coming from Avery's home. When police arrived at about 1:00 AM, we're told Avery answered the door ... then shoved a cop and slammed the door behind him."
TMZ adds that Police then knocked again, andAvery came to his senses and opened up. Avery was extremely cooperative after that, but was still booked for battery on a peace officer.
...while it's great that Avery came to his senses, if you push a cop you are going to jail.
NBC New York is reporting that Sean Avery was arrested and charged with battery on a police office earlier this morning after Los Angeles Police responded to noise complaints at Avery's Hollywood home at about 1 a.m. and arrested him. It wasn't known what prompted the alleged assault on the officer.
...while I don't want to speculate until all the facts are out, you have to wonder how this is going to effect Avery's standing with the team. I know Sather & Avery have a very good relationship but this just might be too much for the Rangers to handle.
Just remember that everyone sided with Howard Berger initially when he claimed Avery made cancer comments to Jason Blake. Avery won that one in court. It is sad everyone is so quick to convict Avery, a guy who gives his all for the team on the ice and gives off the ice as well.
We don't know exactly what happened - the details may eventually come out - but Avery is already guilty because he is Avery. If that bastion of fine journalism TMZ said it, it must be true!
i think this will really affect his chances of making the team. Not so much the actual arrest part but this unfortunatly displays Avery's inability to control himself, something Torts has wanted him to do all season
Sounds like an awesome party. But when I read Avery + Party + L.A. I can't help but think of this... http://www.funnyhub.com/videos/pages/snl-schmitts-gay.html
there's things you do, and there's things you dont do. One of the things you dont do is put your hands on a cop. They tend to frown upon that
Why would he need to shove the guy to shut the door? This sounds entirely defensible. Everbody knows a cop shouldn't just walk up into your house over a noise complaint. Shoving him is a bad idea. You also get the feeling alcohol was involved, which isn't good for him. Oh well Avery will be Avery and if he can help the Rangers then so be it.
I highly doubt coach cares, as long as it doesn't interfere with the team or create a distraction, but if legal proceedings get in the way of camp or something it could be really bad news.
If Avery would have agitated opponents last season the way he did that cop this morning he might have had a better year. ;)
I'm thinking, "yes, the old Avery is back!" It nice to have characters in the league...remember that's how it used to be.
oh brother... what a boneheaded move. And after he spent the entire last season cleaning up his act.... ugh.
@ScottyHockey , "that bastion of fine journalism TMZ"
Ha! I'm cracking up ...
@ScottyHockey Big difference between a douche bag radio host and the LAPD. Are you saying the cops are lying?
@ErinM Definitely not going to help.
@_Jack Probably the best SNL clip of all time.
@KingBadaBing Doubtful. Plenty of athletes have been arrested and not released. Can't imagine that's in his contract. If anyone knows for sure please chime in.
@AnnoyingJoe What are you? The "Police, Police"?
@CJ Agreed. Rarely are athlete who are arrested released form their team.
@AG_Blue Especially for a guy who was going to be fighting for a roster spot in camp.
that's exactly what I mean. Depending on how the club takes it, for a guy on the bubble, this could be kind of a deal-breaker. I know that Torts has no tolerance of that kind of thing; he was over the Avery show before it ever begun. This raises more serious doubts about Avery's future in the NHL.
